FleetSafe.AI End User Licence Agreement (EULA) For Direct, Fleet and Reseller Users

Please read this entire agreement carefully before accessing or using the service.

The FleetSafe Platform (referred to throughout as “the Platform”) is provided and operated by FleetSafe.AI (“we”, “us” or “our”). This EULA is a binding agreement between you, as an individual user, and FleetSafe.AI. It governs your personal use of the Platform.

The Platform is supplied as part of the subscription services purchased by the organisation you represent (for example, as an employee, contractor or authorised representative). We call that organisation “the Customer”. By logging in, you confirm that you are authorised to access the Platform on the Customer’s behalf.

The Platform lets you view and manage data from vehicles in the Customer’s fleet that are fitted with FleetSafe.AI telematics devices. These devices record and transmit live camera footage together with vehicle and driver information. This includes road and driving behaviour data, traffic patterns, environmental factors (such as idling), journey statistics, safety risks at junctions, and analysis of incidents.

Separate commercial terms and conditions govern the supply of hardware and subscription services to the Customer (directly or through an authorised reseller). This EULA is independent of those terms and applies specifically to your individual use of the Platform. Where any provision in the Customer’s terms conflicts with this EULA regarding Platform access, the terms of this EULA take priority.

Grant of Licence
FleetSafe.AI grants you a revocable, non-exclusive, non-transferable right to use the Platform strictly for the Customer’s internal business purposes. This licence begins on your first successful login and continues until it ends in accordance with the termination section below.

By clicking “Accept” on login, you confirm that you have read, understood and agree to be bound by every part of this EULA.

Key Points You Must Accept

1. Only FleetSafe.AI is responsible for operating and maintaining the Platform and all its content. No other party has any liability for it.
2. This EULA works alongside the Customer’s main agreement and is not replaced by it.
3. You must never use the Platform on any device or operating system that has been modified, jailbroken or rooted outside the manufacturer’s official specifications.

No Guarantees Regarding Third-Party Elements
We do not provide or support any external software, devices or internet connections. We cannot promise that your chosen hardware, network provider or internet service will give uninterrupted or fault-free access to the Platform at all times.

Links to External Websites
Any hyperlinks inside the Platform are provided for convenience only. We do not endorse or control the content on those sites and accept no responsibility for their accuracy, availability or privacy practices. You should review the terms and privacy policies of any linked website before using it.

Security and Responsible Use
You must keep your login password confidential and never share it with anyone else.

You agree not to upload, store or transmit through the Platform any material that is:

• unlawful, harmful, threatening, defamatory, obscene, harassing or racially/ethnically offensive;
• likely to encourage illegal activity;
• sexually explicit;
• promotes violence;
• discriminatory on grounds of race, gender, religion, sexual orientation or disability; or
• otherwise illegal or damaging to people or property.

If you breach these rules, we may immediately disable your access without notice or liability.

Intellectual Property
The name “FleetSafe.AI”, our logo and all associated trademarks belong exclusively to us. You may not use, copy or reproduce them in any way.

All copyright, design rights and other intellectual property in the Platform, its layout, screens, text, images and functionality are owned by FleetSafe.AI or its licensors. You are strictly prohibited from:

• copying or reproducing any part of the Platform;
• modifying, adapting or creating derivative works;
• removing or altering any copyright or proprietary notices;
• attempting to decompile, disassemble or reverse-engineer the Platform;
• using the Platform to develop or build any competing product or service; or
• introducing any virus, malware or security vulnerability into the Platform or our systems.

Your Responsibilities
You must not use the Platform for any unlawful, abusive, libellous, obscene or threatening purpose.

You are fully responsible for any claims, losses, damages or costs that arise from:

• your use of the Platform;
• any information or data you provide; or
• any breach of this EULA or infringement of third-party rights.

General Provisions
Support requests, questions or complaints should be submitted through the in-app help or support section.

We may assign or transfer any of our rights under this EULA to another company within our group at any time. You may not transfer or assign your rights or obligations without our prior written consent.

If any court or authority decides that part of this EULA is unenforceable, the rest of the agreement continues in full force. Nothing in this EULA limits any statutory rights you may have as a consumer.

Changes to These Terms
We may update or amend this EULA at any time. When we do, you will be required to accept the revised version the next time you log in. Continued use after that point constitutes acceptance of the new terms.

Termination and Suspension
We may end your access to the Platform immediately if:

• you commit a serious or repeated breach of this EULA (including suspected fraud or unauthorised use);
• you were not entitled to access the Platform or your eligibility changes;
• the Customer breaches its own subscription agreement or that agreement is terminated;
• you refuse to accept updated terms; or
• we reasonably believe continued access would expose us, our group or the Customer to legal, regulatory or security risks.

Your access may also be suspended at any time if we suspect your account details have been compromised or if there is evidence of suspicious activity.

You may cancel your own access at any time by deleting your user account through the Platform settings.

Governing Law
This EULA is governed by the laws of England and Wales.

By using the Platform, you agree to these terms in full. If you do not accept them, you must not log in or use the service.
